Warranty Deed, Park Land Acceptance, and the Commissioners Court Vote (1990)

Carolville, Ltd. conveys 7.38 acres to the County "exclusively for parks and recreational purposes"; County Judge Don Wilson signs a Park Land Acceptance; the Commissioners Court votes 4–1 to accept the deed.

Why it matters

The founding record: the park-use restriction, the County's own dedication language, the Judge's signed acceptance, and the Court's vote — the "proper official action" the County's 2026 agreement says never happened.

The deed (pp. 1–4) has three parts that matter.

  • Conveyance. The land is granted “provided, however, that the herein described property is conveyed exclusively for parks and recreational purposes for public use by the citizens of Williamson County.”
  • Conditions. “As a condition and by acceptance of this conveyance, Williamson County hereby dedicates the herein described property for park and recreational purposes.” This is the County’s own dedication, not just the grantor’s.
  • Reversion. The land would return to Carolville only if the Breakaway Park Section 3 plat was not approved within one year. It was approved in February 1991, so this condition was satisfied and expired thirty-five years ago.

The acceptance (p. 5) is a separately recorded instrument titled “Park Land Acceptance,” signed by County Judge Don Wilson on behalf of Williamson County, accepting “the grant of park land as hereinabove described, subject to all provisions and conditions contained herein.” Filed November 19, 1990; recorded November 20 at Volume 1960, Page 444.

The vote (p. 6). Agenda Item 17, November 19, 1990: Commissioner Mike Heiligenstein moves and Commissioner Wesley Foust seconds a motion “to accept the Warranty deed from Carrollville Ltd. and authorize it to be filed in the Deed Records.” Motion carried 4–1, Judge Wilson voting no.
