How it became a park · February 1991 – March 1995

The Three Recorded Plats (1991, 1994, 1995)

Three subdivision plats approved by Williamson County — and, for Section 3, by the City of Austin — each stating that the parkland requirement was satisfied by this tract and that Williamson County owns it.

Why it matters

Three times over five years, the County affirmed on the public record that it is "the owner of this approved parkland tract." The Section 3 plat also shows the deed's one-year condition was met.

Breakaway Park Section 3 (pp. 1–4). Approved by the Austin Planning Commission on February 12, 1991, signed by County Judge John Doerfler on February 25, and recorded February 26 — inside the deed’s one-year window. The plat map labels the tract “7.38 AC PARK / WILLIAMSON COUNTY / VOL 1960 PG 440.” Three notes concern the park:

  • Note 15: parkland requirements “were satisfied with the dedication of the approved and adjacent parkland tract as recorded in Volume 1960, Page 440-444.”
  • Note 16: Williamson County is the owner of the parkland tract; maintenance rests with the subdivision, not the County.
  • Note 17: Austin’s Land Development Code is the controlling regulatory framework.

Breakaway Park Section 2A (pp. 5–7). Approved by the County on October 26, 1994. Note 5 refers back to the same dedication at Volume 1960, Page 440.

Breakaway Park Section 1A (pp. 8–10). Approved by County Judge Doerfler on March 28, 1995. Note 6: “Williamson County, Texas is the owner of this approved parkland tract.”

Between the deed, the acceptance, the Court’s vote, and these three plats, the County put its ownership of the park on the public record at least six times between 1990 and 1995.
